These Terms & Conditions ("Terms") govern your use of the Delilah Mae Skin website and the purchase and use of services, treatments and products provided by Delilah Mae Skin Pty Ltd (ABN 66 697 119 305) trading as Delilah Mae Skin ("Delilah Mae Skin", "we", "us" or "our").

By accessing our website, making an appointment, purchasing a product or service, or attending our clinic, you agree to these Terms.

Please read them carefully before making a booking.

Nothing in these Terms is intended to exclude, restrict or modify any rights you have under the Australian Consumer Law or any other law that cannot legally be excluded, restricted or modified.

1. Our Approach

At Delilah Mae Skin, we believe your skin should be understood before it is treated.

Our consultations and treatments are personalised to each guest. Recommendations are based on the information available to us at the time of your consultation and treatment, including your skin, health history, current skincare, lifestyle and goals.

Your skin can change over time, which means the treatment or products recommended at one appointment may not be appropriate at another.

Our priority is always the health, safety and wellbeing of your skin.

2. Website Use

You may use our website for personal and lawful purposes.

The information provided on our website is intended for general educational and informational purposes. It is not intended to replace individual medical advice, diagnosis or treatment by an appropriately qualified health professional.

While we take reasonable care to ensure information on our website is accurate and current, treatment information, pricing, availability and other content may change from time to time.

3. Products & Online Purchases

Where products are available for purchase through our website, you agree that:

  • you will provide accurate and complete information when placing an order;

  • you will use products in accordance with the manufacturer's directions and our recommendations;

  • you will notify us if you experience an unexpected or significant reaction to a product;

  • products are subject to availability; and

  • prices are displayed in Australian dollars and include GST where applicable.

We may correct genuine errors in product descriptions, availability or pricing.

If an order has been affected by an obvious pricing or availability error, we may contact you to discuss the issue or cancel the affected order and provide an appropriate refund where required.

Nothing in this section affects your rights under the Australian Consumer Law.

4. Product Returns & Consumer Guarantees

We comply with the Australian Consumer Law.

Consumer guarantees apply automatically to products and services supplied to consumers, including guarantees relating to acceptable quality, fitness for purpose and services being provided with due care and skill.

If a product is faulty, unsafe, does not match its description or otherwise fails to meet a consumer guarantee, please contact us so we can assess the issue and provide an appropriate remedy.

Change-of-mind returns may be subject to our individual return conditions, particularly where a skincare product has been opened or used and cannot reasonably be resold for hygiene reasons.

Nothing in our returns policy limits your rights under the Australian Consumer Law.

5. Special Offers & Promotions

From time to time, we may offer promotions, packages, memberships, introductory offers or other special pricing.

Unless otherwise stated:

  • offers are subject to availability;

  • promotional offers cannot be exchanged for cash;

  • offers cannot be combined with other offers;

  • promotional terms apply only for the period specified; and

  • we may withdraw an offer where permitted by law.

If you have already made a purchase in accordance with the advertised terms of an offer, we will honour that purchase subject to the applicable terms.

6. Prices

All prices are displayed in Australian dollars.

We may change our prices from time to time.

The price applicable to a booking or purchase will generally be the price confirmed at the time you make the booking or purchase.

Where a treatment or service is personalised, the price will be communicated to you before the service is provided.

7. Consultations & Treatment Recommendations

Certain treatments may require a consultation before treatment.

During your consultation, we may discuss your:

  • skin concerns and goals;

  • medical history;

  • medications and supplements;

  • allergies and sensitivities;

  • current skincare;

  • previous treatments;

  • pregnancy or breastfeeding;

  • lifestyle factors; and

  • other information relevant to your treatment.

You agree to provide information that is accurate, complete and current.

Please tell us if your health, medications, skincare or circumstances change between appointments.

8. Treatment Suitability

Booking a particular treatment does not guarantee that the treatment will be performed.

Your skin will be assessed at the time of your appointment and we may recommend modifying, postponing or changing a treatment if we believe this is necessary or more appropriate for your skin or circumstances.

For our personalised treatments, including the Delilah Mae Method, your treatment may be adjusted on the day according to what your skin needs.

Where we recommend an alternative treatment, we will explain why wherever reasonably possible.

9. Advanced Treatments & Skin Penetration

Some Delilah Mae Skin services may involve skin penetration or other procedures that are regulated under Queensland legislation.

Delilah Mae Skin will provide applicable services in accordance with relevant Queensland requirements, including the Public Health (Infection Control for Personal Appearance Services) Act 2003, the Public Health (Infection Control for Personal Appearance Services) Regulation 2016, applicable infection-control requirements and relevant Queensland Health guidelines.

Queensland distinguishes between non-higher-risk and higher-risk personal appearance services. Where a service falls within a higher-risk category, additional licensing and qualification requirements may apply.

Where required, additional consent, preparation, patch testing or treatment requirements will apply.

10. Results

We use evidence-informed treatments and personalised recommendations to support healthier, stronger and more resilient skin.

However, individual skin responses vary.

We cannot guarantee a particular cosmetic or aesthetic outcome, timeframe or result.

Results may be influenced by factors including:

  • individual skin biology;

  • hormones;

  • medications;

  • lifestyle;

  • sun exposure;

  • adherence to home care;

  • healing response;

  • underlying health factors; and

  • consistency of treatment.

Any images, testimonials or examples displayed on our website or social media are illustrative and are not a guarantee of the result you will achieve.

11. New Guest Discovery Consultations

Our New Guest Discovery Consultation is available as a standalone consultation for $99.

Our New Guest Discovery Consultation + Delilah Mae Method Level 1 includes the consultation as part of the first treatment experience, with the consultation being complimentary when booked with the treatment.

A $99 deposit is required to secure an appointment, unless otherwise stated at the time of booking.

For the standalone consultation, the $99 deposit forms part of the consultation fee.

For the New Guest Discovery Consultation + Delilah Mae Method Level 1, the $99 deposit is applied toward the total appointment cost.

12. Booking Deposits

No deposit is required at the time of booking.

A deposit is required no later than 48 hours before your appointment to confirm your attendance.

A secure payment link containing the deposit payment details will be sent to you before your appointment.

Your appointment will only be confirmed once the deposit has been paid through the secure payment link.

If the deposit is not paid and your appointment is not confirmed within the 48-hour period before your appointment, we may offer the appointment time to a guest on our waitlist.

The deposit will be applied toward the applicable service unless otherwise stated.

Where a cancellation, rescheduling or non-attendance occurs within the applicable cancellation period, the deposit may be retained in accordance with our Booking Policy, subject always to your rights under Australian law.

13. Cancellation & Rescheduling Policy

We understand that circumstances can change.

We ask that you provide at least 48 hours' notice if you need to cancel or reschedule an appointment.

A booking deposit must be paid at least 48 hours before your appointment to secure and confirm your appointment time. Until the deposit has been received, your appointment is not considered secured or confirmed, and we may offer the time to guests on our waitlist.

48 hours or more notice

Where you provide at least 48 hours' notice, your deposit may be transferred to another appointment or refunded, subject to any applicable booking conditions.

Less than 48 hours' notice

Where an appointment is cancelled or rescheduled with less than 48 hours' notice, your booking deposit may be forfeited and is subject to the clinic's discretion.

No-show

If you do not attend your appointment and have not contacted us, your booking deposit may be forfeited.

We may also require a further deposit or payment to secure future appointments.

We understand that genuine emergencies and unforeseen circumstances can occur. Please contact us as soon as possible if something unexpected prevents you from attending.

We will consider genuine circumstances reasonably and on a case-by-case basis.

Nothing in this cancellation policy is intended to exclude or limit any rights you may have under the Australian Consumer Law.

14. Late Arrivals

We recommend arriving approximately 5–10 minutes before your appointment.

If you arrive late, we will do our best to provide your treatment within the remaining appointment time.

However, where shortening the appointment would compromise the safety or quality of the service, we may need to modify or reschedule the appointment.

Where an appointment needs to be shortened because of a guest's late arrival, the full booked service fee may still apply.

15. Appointment Reminders

We may send appointment reminders by SMS, email or other electronic communication.

These reminders are provided as a courtesy and do not replace your responsibility to remember your appointment.

If you are unable to attend, please contact us as soon as possible rather than relying solely on the reminder system.

16. Health & Safety

For your safety, you must tell us about any relevant change to your health or circumstances before treatment.

This includes, but is not limited to:

  • new medications;

  • allergies;

  • illness;

  • pregnancy or breastfeeding;

  • recent surgery;

  • recent cosmetic or aesthetic procedures;

  • prescription skincare;

  • skin infections or conditions; and

  • previous adverse reactions.

We may request additional information or recommend that you obtain medical clearance before proceeding with a particular service.

We may decline or postpone treatment where we reasonably believe proceeding would not be appropriate or safe.

17. Pregnancy & Breastfeeding

Some treatments, products and ingredients may not be appropriate during pregnancy or breastfeeding.

Please tell us if you are pregnant, trying to conceive or breastfeeding before your appointment.

We will assess your circumstances and may modify or postpone treatments where appropriate.

Where necessary, we may recommend that you seek advice from your doctor or other appropriately qualified health professional.

18. Medical Conditions & Prescription Treatments

Delilah Mae Skin provides cosmetic and skin health services and does not replace medical diagnosis or treatment.

If you have a diagnosed medical condition, are taking prescription medication or are under the care of a medical practitioner or dermatologist, please let us know.

Where a concern appears to require medical assessment, we may recommend that you consult an appropriately qualified health professional.

19. Payment

Payment for services is due at the time of treatment unless otherwise agreed in writing.

We accept the payment methods made available by Delilah Mae Skin from time to time.

We do not provide credit accounts unless expressly agreed.

Where a payment is declined or cannot be processed, payment will remain due.

We reserve the right to require payment in advance for future appointments where there has been a history of unpaid services, late cancellations or non-attendance.

20. Gift Cards

Gift cards and vouchers may be purchased from Delilah Mae Skin subject to the terms provided at the time of purchase.

Gift cards sold to consumers in Australia generally have a minimum 3-year expiry period, subject to applicable exceptions, and the expiry date must be clearly displayed.

Gift cards cannot be exchanged for cash unless required by law.

Nothing in our gift card terms limits any rights you have under applicable consumer law.

21. Packages & Memberships

Treatment packages, memberships and promotional programs are subject to the specific terms provided at the time of purchase.

Unless otherwise stated:

  • packages and memberships are personal to the named guest;

  • benefits cannot be transferred;

  • treatments remain subject to suitability at each appointment; and

  • unused benefits are subject to the applicable package or membership terms and applicable law.

If a treatment included within a package becomes unsuitable, we will discuss an appropriate alternative where reasonably possible.

22. Skin Imaging & Photography

We may take photographs or use skin imaging as part of your consultation, treatment planning and progress tracking.

These images may form part of your client record.

Clinical photography does not automatically provide consent for marketing use.

We will seek separate consent before using your images for advertising, social media, website content or other promotional purposes.

You are not required to consent to promotional photography in order to receive treatment.

23. Privacy

Your personal information will be collected, used and stored in accordance with our Privacy Policy.

By providing information to us, you acknowledge that we may use that information for purposes reasonably necessary to provide our services, manage your appointments, process payments, maintain records, provide aftercare and comply with our legal obligations.

Health and skin information may constitute sensitive information and will be handled in accordance with applicable privacy laws.

24. Intellectual Property

All content appearing on the Delilah Mae Skin website, including but not limited to:

  • logos;

  • trade marks;

  • treatment names;

  • written content;

  • photography;

  • graphics;

  • designs;

  • videos;

  • educational material; and

  • proprietary methodologies

is owned by or licensed to Delilah Mae Skin Pty Ltd unless otherwise stated.

You may view and print website content for your personal, non-commercial use.

You must not reproduce, modify, distribute, publish, commercially exploit or otherwise use our intellectual property without our prior written permission, except where permitted by law.

25. Third-Party Links

Our website may contain links to third-party websites.

These links are provided for convenience or information only.

We do not control third-party websites and are not responsible for their content, privacy practices, security or availability.

You should review the relevant third-party website's terms and privacy policy before using it or providing personal information.

26. Website Availability

We aim to keep our website available and accurate, but we do not guarantee that the website will always be available, uninterrupted or error-free.

We may modify, suspend or discontinue website content, features or functionality from time to time.

27. Limitation of Liability

The disclaimers, liability limitations and indemnities within these Terms do not exclude, restrict or modify any rights, guarantees, remedies or liabilities that cannot lawfully be excluded, restricted or modified. This includes, without limitation, rights and remedies available under the Australian Consumer Law and any other applicable Queensland or Commonwealth legislation.

To the maximum extent permitted by law, Delilah Mae Skin Pty Ltd, trading as Delilah Mae Skin ("Delilah Mae Skin", "we", "us" or "our"), does not make any express or implied representation or warranty about, and will not be liable in contract, tort (including negligence) or otherwise for, any direct, indirect, special, incidental or consequential loss, damage, cost or expense arising out of or in connection with:

  • your access to, use of, or reliance on our website, content, products or services;

  • any information, product or service being incomplete, inaccurate, unsuitable, unavailable or out of date, including third-party material and advertisements;

  • any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, failure to correct defects, computer virus or other harmful component, loss of data, communication-line failure, unlawful third-party conduct, theft, destruction, alteration or unauthorised access to records;

  • your access to websites, platforms, systems or servers maintained by third parties through links or other references on our website. Links are provided for convenience only. We do not endorse or control linked websites, products or services, and you access them at your own risk;

  • the use of credit-card or other financial information, the failure to complete or delay in completing any transaction, or any other loss or damage arising from a transaction made or attempted through our website; or

  • the use, inability to use, unauthorised use, performance or non-performance of, or reliance upon, our website or content.

To the maximum extent permitted by law, in no event will Delilah Mae Skin Pty Ltd be liable for any loss or damage, including direct, indirect, special, consequential, punitive or incidental loss or damage, or loss of use, profits, revenue, data, business opportunity or other intangible loss, or the cost of procuring substitute products or services, arising out of or relating to your use of, inability to use, unauthorised use of, performance or non-performance of, or reliance upon, our website, content, products or services.

These limitations apply whether the alleged liability arises in contract, tort, negligence, statute, equity or otherwise, and whether or not Delilah Mae Skin Pty Ltd was advised of the possibility of the relevant loss or damage.

However, nothing in these Terms excludes, restricts or modifies:

  • any consumer guarantee, right or remedy under the Australian Consumer Law;

  • any right, remedy, guarantee or liability that cannot lawfully be excluded, restricted or modified under Queensland or Commonwealth law;

  • liability for fraud, wilful misconduct or any other matter for which liability cannot lawfully be excluded; or

  • liability arising from our negligence to the extent that such liability cannot lawfully be excluded or limited.

Where the law permits us to limit our liability, our liability will be limited to the maximum extent permitted by law. Where permitted under the Australian Consumer Law, and at our option, our liability for a failure to comply with a consumer guarantee may be limited to:

  • supplying the services again; or

  • paying the cost of having the services supplied again,

except where the Australian Consumer Law provides a different or additional remedy.

These provisions are governed by the laws of Queensland, Australia, and apply subject to any mandatory rights and protections available under applicable Queensland or Commonwealth law.

28. Complaints & Dispute Resolution

We genuinely want you to feel heard.

If you experience an unusual or unexpected skin response following a treatment or after using skincare products recommended or supplied by us, please contact us as soon as you notice it. Prompt communication allows us to assess what may have occurred and provide relevant guidance or solutions to help minimise any adverse reaction.

If you have a concern about your treatment, purchase or experience, please contact us as soon as reasonably possible.

We encourage you to give us the opportunity to understand what has happened and work with you towards a reasonable resolution.

Where appropriate, we may request relevant information about the service, treatment or purchase so that we can properly investigate your concern.

Nothing in this section limits your right to seek assistance or remedies available under Australian law.

29. Respectful Environment

Delilah Mae Skin is committed to providing a safe, inclusive and respectful environment for our guests and team.

We do not tolerate behaviour that is abusive, threatening, discriminatory, sexually inappropriate, intimidating or otherwise unsafe.

Where necessary, we may refuse or discontinue a service or appointment to protect the safety and wellbeing of our guests and team.

30. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, services, pricing, technology or legal requirements.

The most current version will be published on our website.

Changes will apply from the date stated in the updated Terms and, where required by law, we will provide appropriate notice.

31. Governing Law

These Terms are governed by the laws of Queensland, Australia.

You and Delilah Mae Skin submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth courts exercising jurisdiction in Queensland.
